What happens if I was arrested for DWI in St. Tammany Parish?

Under Louisiana law, once you have been cited for violating the DWI statute, the state initiates two simultaneous, yet separate legal actions against you. The criminal action is in response to the ticket that was issued to you, while the administrative action is brought against your driver's license by the Louisiana Office of Motor Vehicles. While both actions can result in the loss of your driving privileges in Louisiana, it is important to remember that there may be more penalties to consider and each action must be handled on its own.

If you have been charged with DWI, it is a major offense that can have major consequences, including loss of driving privileges, jail time, and monetary fines. It is very important that anyone facing a DWI (DUI) charge understand what challenges they will encounter. It is imperative you seek the legal advice of an aggressive and professional DWI criminal defense lawyer immediately. Call today for a consultation.

Louisiana DUI or DWI Administrative Hearing – Protect your Driver’s License

According to Louisiana law, an individual has 15 days to request an Administrative Hearing from the Louisiana Office of Motor Vehicles. Once the arresting officer retains your state issued driver's license, you are issued a temporary receipt of license. This receipt will serve as your license for the following 15 days in lieu of the one retained by the arresting officer.

Time is of the essence, if you fail to request a hearing within 15 days, your right to the hearing is lost, and your Louisiana driver's license is automatically suspended for the applicable statutory time frame. In order to preserve your right to an administrative hearing, it is crucial that you submit your request to the Louisiana OMV (Office of Motor Vehicles) within 15 days. Contact a capable and experienced DWI lawyer in St. Tammany Parish, Louisiana to help, but do not delay.
