For example, if the machine you were tested on was not working properly or properly calibrated at the time that you blew, or even If the person operating the machine was not qualified, we can attempt to get the results thrown out.  We have advanced training in breath and blood testing.  We are also trained and qualified in field sobriety testing by the National Highway Traffic and Safety Administration.  This is the same agency that trained the officer who administered your roadside tests.  Our training allows us to know if something was done improperly with your field testing, We understand the potential errors of these tests and the motions to file to challenge the evidence.  This may be one way to weaken the state’s case against you.

Summary of New Jersey DWI Laws

Jail time
A first time DWI offender in New Jersey can face up to 30 days in jail. 

Driving Privileges
If convicted of a DWI in New Jersey, you can lose your driver's license for three months to a year, depending on the level of your intoxication and other factors.  If convicted of a DWI in a school zone, the license suspension ranges from 12 to 24 months.

Monetary Fines
For a first time offense, the fine can range from $250 to $500, depending on the BAC level.  For a first time offense in a school zone, the fine can range from $600 to $1,000.

Chemical Test Refusal
In New Jersey, a motorist who refuses to submit to a breath test faces a 7 to 12 months license suspension and $250 to $500 in fines.  If the refusal occurred in a school zone, the fines range from $600 to $1,000, and the motorist faces a 12 to 24 month suspension.  There is no such offense as refusing to submit to a blood test in New Jersey.

Commercial Drivers
A commercial driver only needs a .04 BAC level while operating a commercial vehicle to be convicted of a DWI charge in New Jersey.  However, a commercial driver, if convicted of a DWI in any motor vehicle in New Jersey, will lose not only his regular driving privileges but also his/her commercial driving privileges for 1 year.  The first offense conviction results in a 1 year suspension of the CDL, with a subsequent conviction resulting in a lifetime suspension.

Alcohol Evaluation
Every convicted first offender must attend a minimum of 12 hours of alcohol education classes through the Intoxicated Driver’s Resource Center (IDRC).

Subsequent Offenses
Subsequent DWI offenses in New Jersey carry stiffer penalties. .
